About Long Term Disability
Employees often have group benefit plans that include both short term and long term disability benefits. Professionals may have their own private policies. Oftentimes, the policies are worded in a manner that is difficult for those without legal training to properly interpret. Our office will represent you in litigation with your disability carrier if they unreasonably terminate or refuse to pay disability benefits.
Many cases are resolved by negotiating a lump sum settlement. If you receive a denial from your disability insurance carrier, you should not delay in hiring a lawyer as proceedings may be subject to a deadline.
We realize that when you are unable to work due to a disability, you may not be able to pay a lawyer upfront. For this reason, we will defer our fees until the case settles or is won at trial.
Please keep in mind that long term disability benefits may be payable no matter how you become injured or sick. Disability could have arisen due to arthritis, age, accident, disease or illness.
Kotak Personal Injury law has successfully sued numerous Canadian disability insurers and forced them to live up to their obligations.
